This website and company complies with the DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation), effective from May 2018.
This website, www.baileyandmitchell.com, collects user data using a contact form which forwards all messages in email format to: firstname.lastname@example.org.
The information from these forms is emailed to the address listed above and in the case of a booking being made, or follow up emails being required, is also stored offline on a password protected hard drive for future contact needing to be made in relation to the booking.
To visit a client gallery you will be required to enter your email address and a password. This can and will be stored within Shootproof's own system, on their servers and will be used to email you up to a maximum of four times and only with information relevant to the client gallery you have accessed and not for any other purpose. Only Bailey and Mitchell will have access to your personal data (email address) stored on Shootproof. It will only be used as detailed above, and will not be passed or sold onto any third parties. By logging into a client gallery you agree to opt in to receive relevant emails as described previously.
EXTERNAL WEBSITE LINKS & THIRD PARTIES
Although we so our best to only use safe links in our blogs and information packages, users are advised take caution before clicking any external web links as we cannot always guarantee or verify the contents of said links despite our efforts to do so. Users click on external links at their own risk and we cannot be held liable for any implications caused by visitors doing so.
DATA STORED ON FILE
Bailey and Mitchell may hold the following personal data of booked or potential clients: names, addresses, phone numbers. This may be obtained and held within booking forms, contact forms and contracts as well as soft copy wedding client day documents. Any and all contracts and forms are stored on my password protected home office computer and backed up to offline external hard drives. I also use GDPR compliant system Dropbox to store some copies of client images but never personal information.
CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS
Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”.
Bailey and Mitchell will never photograph an individual as a means of identification or authentication unless contracted to do so with consent of the client. Guests at a weddings or event may appear in photos taken by Bailey and Mitchell as a part of the photographic documentation of the day. Guests captured in portraits, candid images or group photos requested by the hiring couple/company do so as a consensual part of the event and their rights are protected by this policy.
In terms of explicit GDPR compliance, Wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs of guests at an event or wedding is necessary for the interests of Bailey and Mitchell as a photography business and the client unless there is a genuine reason for the protection of an individual’s data or identity. In order to work within the legal parameters of GDPR legislation, providing information to every guest at a wedding or event would make the job we are hired to do infeasible and distract from the work we are hired to do. Clients will therefore be asked as part of their contract to direct their guests to this policy to read and they may contact Bailey and Mitchell with any concerns they may have in lead up to the event.
IMAGE USE & SOCIAL MEDIA
Bailey and Mitchell has official profiles on social media platforms Instagram, Twitter, Facebook and Linked in. Users are advised to verify the authenticity of such profiles before engaging with our profiles. Personal information will not be required through these platforms and clients are advised only to contact us in regards to a booking or personal information by use of the earlier mentinoned email address or website based contact forms.
We may use photographs to promote Bailey and Mitchell on our website, social media, wedding blogs, magazines and their websites, in advertising and brochures and other related material, providing that the images are used lawfully and without any damage to the client. Client consent will always be obtained should images be published outside of the website or social media galleries of Bailey and Mitchell.
